Description of Legal Documents
The following files represent the most pertinent legal documents that establish and define The Sweetwater Hills Homeowner's Association (SWHHA), as well as the obligations of residents. All have been electronically recreated from originals on record at The Henderson County Registry. While we believe them to be accurate in both substance and format, for issues of high legal sensitivity, we would strongly recommend obtaining certified copies directly from Henderson County.
 
Articles of Incorporation June 23, 1988, this document establishes the SWHHA and defines duties.
 
By-Laws March 31, 1989, this document details SWHHA authority and operation.
 
Restrictions and Covenants, Original June 23, 1988, this document details the original obligations of residents, but has been superseded by Amendment 1.
 
Restrictions and Covenants, Amendment 1 January 13, 2003, this document is a complete re-write of the Original, deleting references to the original Developer and revising restrictions for clarification, modernization, and agreement with then current residents' wishes.
 
Restrictions and Covenants, Amendment 2 October 3, 2008, this document is an addendum to Amendment 1 (see Document 4 above) defining SWHHA enforcement authority in case of residents' non-compliance with the Restrictions and Covenants. (interest penalty for past due assessments and fines for other infractions)
